1. ACCEPTANCE OF TERMS By accessing or using the website anchorpointkauai.com or any services provided by Anchor Point Home Services, LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms please do not use our website or services. These Terms apply to all visitors, clients, and others who access or use our services.
2. DESCRIPTION OF SERVICES Anchor Point Home Services, LLC provides the following services: — Systems Audit: A comprehensive property assessment identifying environmental vulnerabilities and smart home installation opportunities — Smart Home Installation: Physical installation of monitoring hardware including sensors, automated water shutoff valves, smart locks, and climate control systems — Monitoring Services: Ongoing 24/7 environmental monitoring through three subscription tiers — The Lookout, The Guardian, and The Commander — Smart Home Expansion Services: Additional smart home technology installation and configuration — Referral Partner Program: A referral compensation program for qualified referral partners
3. SYSTEMS AUDIT The Systems Audit is a $149 property assessment conducted by Anchor Point Home Services, LLC. The following terms apply: — Payment of $149 is due at time of service — The $149 fee is credited in full toward your first month of monitoring service if you elect a protection plan within 30 days of your audit — The audit fee is non-refundable if you choose not to proceed with monitoring services — You will receive a written report within 24 hours of your audit — You do not need to be present — we will coordinate with your property manager or keyholder
4. MONITORING SERVICES The following terms apply to all monitoring service subscriptions: Subscription Terms: — All monitoring plans are month to month with no long-term contracts — You may upgrade, downgrade, or cancel your plan at any time — Cancellation takes effect at the end of your current billing period — No refunds are provided for partial months of service Hardware Ownership: — All hardware installed by Anchor Point Home Services, LLC is owned by you from the date of installation — Hardware continues to function independently if you cancel monitoring service — Anchor Point Home Services, LLC is not responsible for hardware malfunction or failure caused by misuse, acts of nature, or third party interference Monitoring Limitations: — Anchor Point Home Services, LLC monitoring services are preventative and informational in nature — We do not guarantee prevention of all property damage — Monitoring is dependent on active internet connectivity at your property — We are not responsible for monitoring interruptions caused by internet outages, power failures, or force majeure events — Anchor Point Home Services, LLC is not a licensed alarm monitoring company and does not provide emergency dispatch services
5. INSTALLATION SERVICES The following terms apply to all smart home installation services: — All installation services are performed by qualified personnel — Installation pricing covers labor and integration only — hardware is billed at MSRP — A Systems Audit is recommended before any installation service — Anchor Point Kauaʻi performs only services that do not require an electrical or plumbing license — all installations use WiFi, Matter, LoRa, or Zigbee protocols — Any work requiring a licensed electrician or plumber will be referred to an appropriately licensed contractor — Installation appointments are subject to availability and weather conditions
6. PAYMENT TERMS — All payments are due at time of service unless otherwise agreed — We accept check, cash, and electronic payment — Monthly monitoring fees are billed in advance at the beginning of each billing period — Late payments may result in suspension of monitoring services — Returned checks are subject to a $35 returned check fee
7. KAMAAINA AND VETERAN RATES Eligibility for discounted rates requires verification: Kāmaʻāina Rate: — Requires valid Hawaiʻi ID showing a Kauaʻi address — Discount applies to full-time Kauaʻi residents only — 15% discount on monitoring tiers — 10% discount on installation modules — $110/hour labor rate Veteran Rate: — Requires valid Military ID, DD-214, or VA card — Available to active duty military and veterans — 15% discount on monitoring tiers — 10% discount on installation modules — $110/hour labor rate Combined Discount: — Maximum combined Kāmaʻāina and Veteran discount is 20% — Verification must be completed before service begins — Discounts cannot be applied retroactively
8. REFERRAL PARTNER PROGRAM The following terms govern our Referral Partner Program: — Referral fees are paid as a flat fee per successful referral — Payment is triggered when a referred client completes 45 consecutive days of active paid monitoring service — Payment is made by check or ACH within 5 business days of Day 45 — never cash — Referral fees are calculated on standard undiscounted rates even if the client receives a new client discount — A written introduction via email or text is required before the referred client's first contact with Anchor Point Home Services, LLC — First documented introduction wins if multiple parties claim the same referral — No fee is paid if the referred client cancels before Day 45 — A 1099-NEC will be issued to any partner receiving $600 or more annually — Referred clients receive 25% off their first month of monitoring service Referral Fee Schedule: Tier 1 — The Lookout: $75 Tier 2 — The Guardian: $150 Tier 3 — The Commander: $250
9. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law: — Anchor Point Home Services, LLC total liability to you for any claim arising from our services shall not exceed the total amount paid by you for services in the three months preceding the claim — We are not liable for any indirect, incidental, special, consequential, or punitive damages — We are not liable for property damage that occurs despite our monitoring services being active — We are not liable for damage caused by hardware malfunction, internet outages, power failures, or events beyond our control
10. INDEMNIFICATION You agree to indemnify, defend, and hold harmless Anchor Point Home Services, LLC , its owner, employees, and agents from any claims, damages, losses, or expenses arising from: — Your use of our services — Your violation of these Terms — Your violation of any third party rights — Any damage to your property that occurs despite our services
11. INTELLECTUAL PROPERTY All content on anchorpointkauai.com including text, graphics, logos, images, and service descriptions is the property of Anchor Point Home Services, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.
12. THIRD PARTY SERVICES Our services integrate with third party smart home platforms and services including but not limited to: — Home Assistant — Boldr smart home systems — Google Nest — Arlo — Eufy — Lutron Caseta We are not responsible for the terms, privacy practices, or performance of these third party services. Their use is subject to their own terms of service.
13. SERVICE AREA Anchor Point Home Services, LLC provides services exclusively within Kauaʻi County, Hawaiʻi. We reserve the right to decline service requests outside our service area.
14. MODIFICATIONS TO SERVICES We reserve the right to: — Modify or discontinue any service at any time — Change pricing with 30 days written notice to active clients — Update these Terms at any time by posting the revised Terms on our website Continued use of our services after any changes constitutes your acceptance of the new Terms.
15. GOVERNING LAW These Terms are governed by and construed in accordance with the laws of the State of Hawaiʻi without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Kauaʻi County, Hawaiʻi.
16. DISPUTE RESOLUTION Before filing any legal claim you agree to first contact us in writing at: info@anchorpointkauai.com We will make a good faith effort to resolve any dispute within 30 days of receiving written notice.
17. SEVERABILITY If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
18. ENTIRE AGREEMENT These Terms, together with our Privacy Policy, constitute the entire agreement between you and Anchor Point Home Services, LLC regarding our services and supersede all prior agreements and understandings.
